Terms of Service

These Terms of Service ("Terms") govern your use of NearVibe (the "Service").

By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old to use the Service.

By creating an account, you represent and warrant that:

· You are at least 18 years old.

You have the legal capacity to enter into this agreement.

All information you provide is accurate.

We reserve the right to verify age at any time.

2. Child Safety Standards and Prohibition of CSAM and CSAE

NearVibe is intended exclusively for adults aged 18 and older. We have zero tolerance for child sexual abuse and exploitation (CSAE), child sexual abuse material (CSAM), grooming, sextortion, child sex trafficking, or any other sexual exploitation or endangerment of minors. For purposes of these Terms, a child or minor is any person under the age of 18.

2.1 Protection of Minors and Age Restrictions

Users must not create accounts while under 18, misrepresent their age, upload images or other content depicting minors, or attempt to contact minors through the Service. You must not assist a minor in accessing NearVibe or evading our age restrictions.

Report suspected underage accounts through the in-app reporting tools or by contacting . We may suspend an account while verifying age and will terminate access if we confirm that the user is under 18. Related content may be removed and relevant records securely retained where required or permitted by applicable law, including for child safety investigations and reporting.

2.2 Definitions

Child Sexual Abuse and Exploitation (CSAE) means content or conduct that sexually abuses, exploits, or endangers a child, including grooming, sexual solicitation, sexual extortion, and child sex trafficking, whether online or offline.

Child Sexual Abuse Material (CSAM) means visual material depicting a child engaged in sexually explicit conduct, or otherwise constituting child sexual abuse material under applicable law. It includes photographs, videos, and computer-generated imagery. NearVibe also prohibits AI-generated, manipulated, illustrated, or other synthetic content depicting the sexual abuse or exploitation of children.

2.3 Prohibited Content and Conduct

These rules apply throughout the Service, including profiles, images, videos, private messages, links, and other User Content. You must not use the Service to:

· Create, upload, store, request, obtain, share, sell, promote, or distribute CSAM, including links or instructions facilitating access to such material;

· Engage in, encourage, facilitate, or promote CSAE;

· Groom a child, engage in sexualized interaction with a child, solicit sexual contact, or request sexual images or videos from a child;

· Threaten, coerce, blackmail, or sexually extort a child, including through real or alleged intimate material;

· Advertise, arrange, facilitate, or participate in child sex trafficking or commercial sexual exploitation of children;

· Sexualize children or promote their sexual abuse or exploitation;

· Direct users to external websites, groups, services, or offline activities involving CSAM or CSAE;

· Encourage minors to join the Service or assist anyone in evading age restrictions or child safety enforcement.

These prohibitions apply regardless of any claimed consent or relationship.

2.4 Reporting Child Safety Concerns

Users may report suspected CSAM, CSAE, or underage accounts through the in-app reporting tools described in Section 7 or by contacting .

Where available, provide the relevant account identifiers, content location, and a description of the concern. Do not download, copy, attach, or redistribute suspected CSAM to submit a report. Identify the original content through the in-app reporting tools whenever possible.

If a child appears to be in immediate danger, contact local emergency services or law enforcement.

2.5 Review and Enforcement

Child safety reports receive priority review. Upon obtaining actual knowledge of suspected CSAM or CSAE, we will promptly review the matter and take appropriate protective action, which may include disabling access to reported content or suspending associated accounts while the review is pending.

When we become aware of CSAM on the Service, we will promptly remove or disable access to it. Confirmed CSAM or CSAE violations will result in removal of the offending content and permanent termination of the responsible accounts. We may also restrict future registrations to prevent further misuse.

We will securely preserve relevant records and evidence where required or permitted by applicable law, restrict access to authorized persons, and handle related personal information in accordance with our Privacy Policy and applicable law.

2.6 Reporting to Authorities

We will comply with applicable child safety laws and reporting obligations, including reporting confirmed CSAM to the National Center for Missing & Exploited Children (NCMEC) or the relevant regional authority, as applicable and where required by law. We will cooperate with lawful requests from competent authorities. Reporting and protective action will not be delayed solely because an internal review remains ongoing when applicable law requires earlier action.

2.7 Child Safety Contact

Child safety concerns, notifications, and inquiries regarding our CSAM and CSAE policies, review procedures, or enforcement practices may be directed to the NearVibe Team at . Child safety reports receive priority handling.

The NearVibe Team can be reached through this address for referral to the designated child safety point of contact responsible for handling child safety notifications, discussing our prevention and review practices, and coordinating necessary action.

3. User Accounts

Users are responsible for:

· Maintaining account security

· Keeping login credentials confidential

· Activities occurring under their account

· You may not transfer your account to another person.

4. Community Guidelines

Users may not:

· Harass or threaten others

· Promote violence

· Engage in hate speech

· Share illegal content

· Commit fraud or scams

· Impersonate another person

· Upload malware or harmful software

· Engage in sexually exploitative behavior

· We reserve the right to remove content or terminate accounts at our sole discretion.

Child sexual abuse and exploitation (CSAE), child sexual abuse material (CSAM), grooming, sextortion, child sex trafficking, and any other conduct prohibited by Section 2 are strictly prohibited.

5. Messaging and User Interactions

The Service allows communication between users.

We are not responsible for:

· User-generated messages

· Statements made by users

· Offline interactions between users

· Users should exercise caution when communicating with others.

The general statements concerning responsibility in this section do not limit our child safety commitments under Section 2 or any non-excludable obligations under applicable law.

6. User Generated Content

You retain ownership of content you submit.

However, by posting content, you grant us a worldwide, royalty-free license to:

· Host

· Display

· Store

· Process

· Distribute

· such content solely for operating and improving the Service.

All User Generated Content, including profiles, private messages, images, videos, and links, must comply with Section 2. The content license above does not authorize any CSAM, CSAE, or other prohibited material.

We may securely preserve relevant records and evidence following content removal or account termination where required or permitted by applicable law for child safety reporting, investigations, and cooperation with competent authorities. Related personal information will be handled in accordance with our Privacy Policy and applicable law.

7. Reporting and Blocking

Users may:

We investigate reports and may take action including:

· Content removal

· Warning notices

· Account suspension

· Permanent bans

Users can report suspected CSAM, CSAE, underage accounts, or other child safety concerns through the in-app reporting tools without leaving NearVibe, or by contacting . Where possible, identify the original content or relevant account. Do not download, copy, attach, or redistribute suspected CSAM when reporting it.

Child safety reports receive priority review and are handled in accordance with Section 2, including content removal or disabling of access, account enforcement, lawful evidence preservation, and reporting to NCMEC or the relevant regional authority as applicable.

Users may block other users through the blocking tools. Intentionally false or malicious reports and attempts to evade child safety enforcement are prohibited.

8. Premium Services

The Service may offer:

· VIP memberships

· Subscription plans

· Premium features

· Unlockable private content

· Features and pricing may change at any time.

9. Subscriptions

Subscriptions automatically renew unless canceled through Google Play.

Users may manage subscriptions through their Google Play account settings.

Refunds are subject to Google Play policies.

10. Prohibited Content

Users may not upload content containing:

· Child sexual abuse material (CSAM), content involving child sexual abuse and exploitation (CSAE), or material otherwise prohibited by Section 2

· Non-consensual intimate content

· Extreme violence

· Terrorist content

· Illegal drugs

· Fraudulent schemes

· Copyright infringement

· Such content may be removed without notice.

When we become aware of CSAM on the Service, we will promptly remove or disable access to it and take the other actions described in Section 2.

11. Account Suspension and Termination

We may suspend or terminate accounts that:

· Violate these Terms

· Pose safety risks

· Engage in fraudulent behavior

· Harm other users or the Service

· Termination may occur without prior notice.

Confirmed CSAM or CSAE violations will result in permanent termination of the responsible accounts. We may restrict future registrations to prevent further misuse. These actions are in addition to the content removal, evidence preservation, and reporting measures described in Section 2.

12. Disclaimer

The Service is provided "AS IS" and "AS AVAILABLE."

We make no guarantees regarding:

· Availability

· Accuracy

· Reliability

· Compatibility

13. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

· Indirect damages

· Incidental damages

· Consequential damages

· Loss of profits

· Loss of data

· arising from use of the Service.
